Terms and Conditions

Article 1 – Purpose

These Terms and Conditions govern sales concluded via the Atelier Symbiose website between:

  • The Company: Atelier Symbiose
  • And any natural or legal person making a purchase via the website.

Any order implies unreserved acceptance of these Terms and Conditions.

Article 2 – Products

Atelier Symbiose offers:

  • Ready-to-plant plant compositions
  • Perennials and shrubs
  • Gardening accessories
  • Personalized planting plans

As living products are by nature evolving, photographs and visuals are non-contractual. Variations in size, flowering or development do not constitute a defect.

Article 3 – Order

The order is validated after:

  • Payment confirmation
  • Receipt of a confirmation email

Atelier Symbiose reserves the right to cancel an order in case of stock problems, obvious error or force majeure.

Article 4 – Prices

  • Prices are indicated in euros.
  • VAT not applicable (small business scheme).
  • Delivery costs are indicated before order validation.

Article 5 – Delivery

Areas served: Belgium, France, Netherlands

Average delivery time: 5 to 10 business days. These times are indicative.

Atelier Symbiose cannot be held responsible for delays attributable to the carrier. Risks are transferred to the customer upon delivery.

Article 6 – Living products & exclusion of withdrawal right

In accordance with European legislation (article VI.53 of the Belgian Code of Economic Law), the right of withdrawal does not apply to:

  • Plants, plant compositions and perishable products
  • Products likely to deteriorate rapidly
  • Custom-made personalized plans

No return or refund can be required for these products, except in case of proven error by the company.

Article 7 – Complaints

Any complaint concerning a damaged product must be sent within 24 hours of receipt with:

  • Clear photos of the package
  • Photos of the product
  • Description of the problem

After this period, no complaint can be taken into account.

Article 8 – Liability

Atelier Symbiose cannot be held responsible for:

  • Planting conditions
  • Maintenance
  • Climate
  • Soil quality
  • Implementation errors by the customer

The advice provided is given for information purposes only.

Article 9 – Force majeure

Atelier Symbiose cannot be held responsible in case of unforeseeable events: exceptional weather conditions, phytosanitary restrictions, supplier shortage, etc.

Article 10 – Applicable law

These Terms and Conditions are governed by Belgian law. Any dispute falls under the jurisdiction of the courts competent for the company's registered office.
